Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use Cardpulse. By using the Services, you represent that you meet this requirement, that you have the legal capacity to enter into this agreement, and that the information you provide is true, complete, and accurate.
§ 2
Your account
Authentication. Cardpulse authenticates users via Google OAuth. You are responsible for safeguarding the Google account you use to sign in. We are not liable for losses arising from unauthorized access to your Google account.
One person, one account. You may not create multiple accounts to circumvent rate limits, free tiers, or any other Service limitation.
Accuracy. You agree to keep your account information current and to notify us of any unauthorized use of your account at [email protected].
§ 3
Acceptable use
You agree not to:
- scrape, mirror, or otherwise systematically extract pricing data from the Services, except via official means we provide
- attempt to derive aggregate market statistics about any third-party marketplace category (e.g., “average eBay price for Sports Trading Cards”) — this restriction mirrors our obligations under the eBay API License
- redistribute, resell, or sublicense the comp data we surface without our written permission
- interfere with the Services, attempt to gain unauthorized access to non-public areas, or probe for vulnerabilities outside a coordinated security-research process
- use the Services to harass, defraud, or harm any person, or for any unlawful purpose
- misrepresent any output of the Services as endorsed or certified by eBay, PriceCharting, GoCollect, PSA, BGS, CGC, SGC, or any other third party we source data from
§ 4
Pricing data and third-party sources
Cardpulse is not affiliated with eBay, PriceCharting, GoCollect, PSA, Beckett, CGC, SGC, or any other third-party data source. The pricing comparables we surface are aggregated from public marketplace data and third-party APIs we license. Source attribution accompanies each comp; every individual price links back to the listing or product page of origin.
No warranty of accuracy. Marketplace data changes constantly. We make no representation that the prices you see are current to the second, free of error, or representative of what any specific buyer or seller would actually accept. You are solely responsible for any pricing decision you make using the Services.
Third-party API rate limits and outages. Some sources may be temporarily unavailable due to rate limits, subscription gating (e.g., eBay Marketplace Insights), or outages outside our control. We will surface the gap honestly rather than fill it with fabricated data.
eBay attribution. Where Cardpulse surfaces eBay listing data, eBay’s name and marks belong to eBay Inc. and are used for identification only. eBay has not endorsed Cardpulse and is not responsible for the Services. Each eBay-sourced comp links back to the original eBay listing.
§ 5
AI-assisted recommendations
Cardpulse offers tools — including agentic price recommendations, decision cards, and chat-style assistance — that are powered by artificial intelligence (currently Anthropic’s Claude). These tools generate output by analyzing the comp data we have access to at the moment of inference.
Output is not financial or investment advice. AI-generated recommendations are tools to inform your judgment, not to replace it. Trading cards and comic books are illiquid, condition-sensitive collectibles whose prices can move sharply. Do not treat any AI-generated number as a guaranteed transaction price or as professional appraisal.
Human override is always available. Every recommendation surfaces its inputs, the comparables it relied on, and a one-click path for you to adjust the price or reject it. Decisions you apply to your inventory are recorded with full provenance.
§ 6
Subscriptions, fees, and refunds
Cardpulse offers free and paid plans. If you subscribe to a paid plan, you authorize us, through Stripe, to charge the payment method on file at the cadence you select (monthly or annual). Fees are stated on the pricing page at the time of purchase and are exclusive of taxes; you are responsible for any applicable taxes.
You may cancel a subscription at any time from your account settings. Cancellation stops further billing at the end of the current period; we do not pro-rate refunds for partial periods unless required by law.
§ 7
Intellectual property
The Services. The software, design, brand, and content of Cardpulse — excluding third-party data we license and your own content — are owned by Card Pulse, LLC and protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to our trademarks or trade dress beyond what is necessary to use the Services as intended.
Your content. You retain all rights in inventory data, notes, and other content you upload. You grant Card Pulse a non-exclusive, royalty-free license to host, display, and process that content solely as needed to provide the Services to you.
Feedback. If you send us suggestions or feedback, we may use them without obligation to you.
§ 8
Disclaimers
The Services are provided “as is” and “as available.” Card Pulse, LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and the accuracy or completeness of any pricing data. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
§ 9
Limitation of liability
To the fullest extent permitted by law, Card Pulse, LLC and its officers, members, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Services. Our total liability for any claim arising under these Terms is limited to the greater of (a) the amount you paid Card Pulse for the Services in the twelve months preceding the claim, or (b) one hundred US dollars (US$100).
Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent the law permits.
§ 10
Indemnification
You agree to defend and indemnify Card Pulse, LLC against any claim, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Services in violation of these Terms or any applicable law, (b) your content, or (c) your infringement of any third party’s rights. We reserve the right, at our own expense, to assume exclusive defense of any matter for which you owe indemnification, in which case you agree to cooperate.
§ 11
Termination
You may stop using the Services at any time and may close your account from settings. We may suspend or terminate your access if you violate these Terms, if continued provision risks harm to other users or to us, or if a third-party data source revokes our access to data you depend on. On termination, the sections of these Terms that by their nature should survive will survive.
§ 12
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts. Nothing in these Terms waives any right you have under mandatory consumer-protection laws of your country of residence.
§ 13
Changes to these Terms
We may update these Terms as the Services evolve. The “Last updated” date at the top reflects the most recent revision. Material changes will be announced in-app or by email. Continued use of the Services after the effective date of an update constitutes acceptance of the updated Terms.
